KindWorld —
A website-hosted user interface, the "Interface", made available by Kind Fintech, a company incorporated in United Arab Emirates. In these Terms, "KindWorld", "we", "us", "our", and "the Company" all refer to that entity.
The Interface is a visual and interactive representation of the KindWorld Protocol, the "Protocol". The Protocol is a suite of open-source, permissionless deployed smart contracts and integrations operating across the Solana blockchain and supported networks.
The Interface provides access to the following products and features, collectively the "Services":
- KindWorld DEX — a decentralised exchange aggregator routing token swaps across liquidity sources on Solana
- KindWorld Perps — a perpetual futures trading interface powered by Hyperliquid through a third-party bridge integration
- KindWallet - a non-custodial web3 mobile wallet
- KindPredict — a decentralised prediction marketplace operating on Solana
- Staking — a token staking module for KindWorld-native assets
These Terms of Use, together with any terms and conditions incorporated by reference, collectively the "Terms", govern your access to and use of the Interface and Services.
For clarity throughout these Terms:
- "KindWorld", "we", "us", "our", and "the Company" refer to Kind Fintech
- "You", "your", and "user(s)" refer to any individual or entity that accesses or uses the Interface in any capacity
If you act on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms. In that case, "you" also includes that entity.
By accessing, browsing, or otherwise using the Interface, or by acknowledging agreement to the Terms within the Interface, you confirm that you have read, understood, and accepted all of the Terms and our , which is incorporated by reference.

1. Eligibility
General
You may not use the Interface if applicable law or regulation in your jurisdiction prohibits you from doing so.
Legal responsibility
You are solely responsible for ensuring your access to and use of the Interface complies with all laws and regulations that apply to you.
Your use of the Interface must not violate, or facilitate the violation of, any applicable law, regulation, or third-party right.
The Interface and Services do not constitute, and may not be used as, an offer or solicitation in any jurisdiction where that activity is not authorised, or to any person for whom that offer or solicitation is unlawful.
By using the Interface, you represent that you are not subject to sanctions or listed on any prohibited or restricted parties list, including lists maintained by the United Nations Security Council, the European Union or its Member States, or any other competent governmental authority.
We make no representation that the Interface or Services are suitable, available, or lawful for use in all jurisdictions.
We reserve the right to restrict or limit access to the Interface at any time, in any jurisdiction, at our sole discretion.
Prohibited localities
KindWorld does not permit access from wallets located in, established in, or resident of the following jurisdictions:
- Republic of China (Taiwan)
- Singapore
- Myanmar (Burma)
- Côte d'Ivoire (Ivory Coast)
- Cuba
- Crimea and Sevastopol
- Democratic Republic of Congo
- Iran
- Iraq
- Libya
- Mali
- Nicaragua
- Democratic People's Republic of Korea (North Korea)
- Somalia
- Sudan
- Syria
- Yemen
- Zimbabwe
- Any other jurisdiction subject to sanctions enforced by the United States, the United Kingdom, or the European Union
You must not use any virtual private network, proxy, or other technical means to circumvent or disguise your true location or to bypass this restriction.
Non-circumvention
You agree not to access the Interface using any technology or method intended to circumvent these Terms.
2. Compliance obligations
Access to and use of the Interface may not be available or appropriate in all jurisdictions.
By using the Interface, you accept sole and complete responsibility for compliance with all applicable laws and regulations, including those relating to virtual assets, derivatives, financial services, and prediction markets.
You further acknowledge that KindWorld has no obligation to advise you of any potential legal exposure or regulatory requirements arising from your use of the Interface.
KindWorld bears no liability for your failure to comply with applicable law.
3. Access to the Interface
We reserve the right to suspend, restrict, or terminate access to the Interface at any time, without liability, including where we reasonably believe you have breached these Terms or no longer satisfy the eligibility requirements in Section 1.
The Interface and Protocol may rely on third-party services including:
- Decentralised oracles
- Liquidity providers
- Routing engines
- Perpetuals bridge integrations, including Hyperliquid and associated third-party protocols
- RPC infrastructure
- Analytics tools
The Interface may be adversely affected by risks associated with these third-party dependencies, including technical interruptions, network congestion, security vulnerabilities, cyberattacks, or protocol-level failures.
Access to the Interface or certain Services may be degraded or unavailable during periods of significant market volatility or high transaction volume.
KindWorld does not guarantee uninterrupted access to the Interface, any specific Service, or any third-party integration.
You agree that KindWorld is not liable for any losses arising from access restrictions, interruptions, or third-party service failures.
4. Your use of the Interface
By using the Interface, you represent and warrant that you understand the inherent risks of interacting with virtual assets, blockchain networks, smart contracts, decentralised protocols, prediction markets, and leveraged financial instruments.
You also agree that KindWorld is not responsible for losses or damages arising from those risks.
You specifically acknowledge and agree that:
- KindWorld DEX — pricing information displayed through the Interface is provided by third parties and calculated for informational purposes only. It does not constitute an offer, recommendation, or solicitation to transact.
- KindWorld Perps — perpetual futures trading involves significant risk of loss, including the possibility of losing your entire position. Leveraged instruments are complex and may not be suitable for all users. KindWorld does not provide financial advice in connection with Perps trading.
- KindPredict — prediction market participation involves financial risk. Outcomes are uncertain and market liquidity may vary. KindWorld does not guarantee any outcome, payout, or resolution timing.
- Staking — staking involves locking digital assets and is subject to smart contract risk, slashing risk where applicable, and market price risk. Staking rewards are not guaranteed.
- The Interface does not act as agent, broker, dealer, exchange, fund manager, custodian, or financial intermediary for any user.
- KindWorld does not own or control the underlying blockchain infrastructure or smart contract networks and is not responsible for their operation.
- You are solely responsible for reporting and paying any taxes applicable to your use of the Interface.
- Information on the Interface may not always be accurate, complete, or current. You should verify all information independently before acting on it.
In using the Interface, you agree that you will not:
- Breach these Terms or any applicable law, rule, or regulation
- Infringe any copyright, trademark, patent, right of publicity, right of privacy, or other proprietary or intellectual property right
- Deploy viruses, malware, or other harmful code, or interfere with the integrity, security, or functioning of the Interface or any connected infrastructure
- Attempt to obtain private keys, wallet seeds, account credentials, or security information from any other user
- Decompile, reverse engineer, or attempt to derive the source code or underlying logic of the Interface
- Seek to defraud KindWorld or any other person, including through provision of false, misleading, or inaccurate information
- Engage in manipulative trading practices, including spoofing, wash trading, or any conduct that undermines the integrity of markets
- Disguise or mask your IP address, or otherwise prevent accurate identification of your access location
- Transmit, exchange, or facilitate the proceeds of criminal or fraudulent activity
All information provided through the Interface is for informational purposes only and does not constitute professional legal, financial, tax, or investment advice.
You should seek independent professional advice before making any decision based on information provided through the Interface.
These Terms do not create, and nothing in the Interface will be construed to create, any fiduciary duty owed by KindWorld to you.
To the fullest extent permitted by law, any such duties are disclaimed, waived, and eliminated.
5. Non-custodial nature of the Interface and Protocol
The Interface and Protocol are entirely non-custodial.
KindWorld does not at any time hold, control, or have access to your digital assets.
Any digital assets acquired, staked, traded, or otherwise managed through the Interface are held and administered solely by you through your own electronic wallet.
KindWorld has no access to, responsibility for, or control over your wallet or any assets held in it.
You are solely responsible for selecting and securing your wallet and for maintaining the confidentiality of your private keys.
KindWorld will never ask for your private keys or wallet seed phrase.
You should never share them with any party.
KindWorld does not operate, own, or control any electronic wallet service, blockchain network, or third-party service you may access in connection with the Interface.
KindWorld is not liable for the acts or omissions of any such third parties, or for any loss resulting from your transactions or interactions with them.
By using the Interface, you irrevocably waive, release, and discharge all claims against KindWorld and its affiliates arising from your use of any wallet software, transaction failures, loss of access to digital assets, smart contract defects, or any other issue arising in connection with your electronic wallet or on-chain interactions.
Neither KindWorld, the Interface, nor the Protocol provides any digital asset exchange service, portfolio management service, investment advice, or custody service.
All decisions to transact are your own, and any consequences arising from those transactions are your sole responsibility.
KYC / AML
We reserve the right to conduct Know Your Customer and Anti-Money Laundering verification checks at our sole discretion, or where required by applicable law.
Upon request, you agree to promptly provide all information and documentation we deem necessary for those checks.
We may suspend or restrict your access to the Interface pending completion of those checks, or permanently where we have grounds to suspect involvement in illegal activity, money laundering, or terrorist financing.
6. Disclaimers
The Interface enables access to decentralised, autonomous protocols and blockchain networks that are not owned, operated, or controlled by KindWorld.
KindWorld does not have access to your private keys, cannot initiate transactions on your behalf, and cannot modify or reverse any on-chain interaction.
KindWorld does not represent or guarantee that any information available through the Interface, including pricing data, oracle feeds, market data, prediction market odds, or staking yields, is accurate, reliable, current, complete, or fit for any particular purpose.
All such information is provided by third parties or calculated algorithmically for informational purposes only.
Your use of the Interface is at your sole risk.
The Interface is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, or security.
You acknowledge that:
- Blockchain-based digital asset markets are highly volatile and subject to rapid, unpredictable change
- Smart contracts may contain bugs, vulnerabilities, or behave unexpectedly
- Perpetual futures and leveraged instruments carry a high risk of loss and are not appropriate for all users
- Prediction market outcomes are inherently uncertain and depend on external events, oracle resolution, and protocol mechanics
- Staking rewards are variable, non-guaranteed, and subject to smart contract and economic risk
- KindWorld is not responsible for any loss arising from the foregoing
The Interface may contain links or references to third-party resources, services, or promotions that we do not control.
KindWorld does not endorse, verify, or assume responsibility for any such third-party content.
Your access to or reliance on third-party resources is at your own risk.
7. Intellectual property rights
KindWorld owns all intellectual property and other proprietary rights in the Interface and its contents, including software, text, images, trademarks, service marks, copyrights, and designs.
Nothing in your access to or use of the Interface constitutes a grant of any intellectual property rights to you.
You may not copy, modify, adapt, distribute, sublicense, sell, or otherwise permit any third party to access or use the Interface or its contents except as expressly authorised by us.
You retain ownership of any information or materials you submit through the Interface.
By doing so, you grant KindWorld a worldwide, royalty-free, irrevocable licence to use, process, store, and distribute that data as necessary to operate the Interface and Services and as permitted by applicable law.
Any feedback, suggestions, or ideas you submit regarding the Interface, "Feedback", may be used by KindWorld at its discretion, without obligation or compensation to you.
By submitting Feedback, you grant KindWorld a perpetual, irrevocable, transferable, worldwide licence to incorporate and use that Feedback for any purpose.
Subject to your compliance with these Terms, KindWorld grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Interface solely for its intended purposes.
This licence may be revoked at any time, with or without cause.
8. Indemnification
You agree to defend, indemnify, and hold harmless KindWorld and its affiliates, officers, directors, employees, contractors, and agents from and against all claims, damages, obligations, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or relating to:
- Your access to or use of the Interface or any Service
- Your violation of these Terms or any applicable law, rule, or regulation
- Your infringement of any third-party right
- Any third party's access to or use of the Interface facilitated by you
9. Limitation of liability
To the maximum extent permitted by applicable law, KindWorld and its affiliates, officers, directors, employees, contractors, and agents are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages.
This includes loss of profits, revenue, goodwill, data, or digital assets arising out of or in connection with your access to or use of the Interface or any Service, regardless of the basis of the claim and even if KindWorld has been advised of the possibility of such damages.
KindWorld's total aggregate liability to you under these Terms will not exceed the greater of:
- The amount you have paid to KindWorld in the twelve (12) months preceding the event giving rise to the claim
- USD $100
This limitation of liability applies to the fullest extent permitted by law and regardless of whether the claim is based in contract, tort, including negligence, strict liability, or otherwise.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
10. Dispute resolution and arbitration
Binding arbitration
Except for disputes in which either party seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, you and KindWorld agree to:
- Waive the right to have any dispute arising from these Terms, or your use of or access to the Interface, resolved in a court of law
- Waive any right to a jury trial
All disputes that cannot be resolved informally must be submitted to binding individual arbitration.
No class actions
Any dispute between you and KindWorld is personal to you.
You and KindWorld agree that no dispute may be brought as a class arbitration, class action, or any other form of representative proceeding, whether within or outside arbitration.
Process
Either party must notify the other in writing of any dispute within thirty (30) days of it arising, with a view to resolving the matter informally and in good faith.
Notice to KindWorld must be sent to [email protected] and must include:
- Your name and contact details
- A description of the dispute
- The specific relief sought
If the dispute cannot be resolved informally within thirty (30) days of KindWorld receiving notice, either party may initiate formal arbitration proceedings.
Any claim must be commenced within one (1) year of the date the dispute arose.
Claims not commenced within that period are permanently barred.
Governing law
These Terms and any disputes arising under them are governed by the laws of [JURISDICTION], without regard to conflict of laws principles.
Any unresolved dispute shall be referred to and finally settled by binding arbitration in accordance with the rules of the London Court of International Arbitration, conducted in English.
The seat of arbitration shall be London, United Kingdom.
Judgment upon any arbitral award may be entered in any court of competent jurisdiction outside the United States of America.
11. Miscellaneous
Changes to Terms. We may amend these Terms at any time by posting a revised version with an updated effective date.
Continued use of the Interface following that posting constitutes your acceptance of the revised Terms.
If you do not agree to an amendment, you must stop using the Interface.
Entire agreement. These Terms, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and KindWorld with respect to the Interface and supersede all prior agreements, representations, and understandings.
Privacy Policy. Our describes how we collect, use, store, and disclose your personal data. By using the Interface, you agree to the data practices described there.
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Survival. Provisions of these Terms that by their nature should survive termination, including Sections 5, 6, 7, 8, 9, and 10, shall survive any expiration or termination.
Language. These Terms are written in English. If any conflict arises between the English version and any translated version, the English version prevails.
Waiver. No failure by KindWorld to exercise or enforce any right under these Terms constitutes a waiver of that right.
